Surry County Background Check Guide
Surry County is in the foothills of northwestern North Carolina. Dobson is the county seat. Mount Airy, the largest town, is widely known as the inspiration for Mayberry from The Andy Griffith Show. The county was formed in 1770 and covers about 538 square miles along the Virginia border. Pilot Mountain is a prominent landmark visible from much of the county. Around 72,000 people live in Surry County. The sheriff's office handles law enforcement outside municipal limits. All court records are kept by the Clerk of Superior Court in Dobson. North Carolina law guarantees public access to most of these records.

Surry County processes a moderate volume of cases. The courthouse in Dobson is relatively small, so finding help from staff is usually easy. If you need older records that predate the electronic system, ask the clerk for paper file access.
Surry County's population of around 72,000 is spread across a mix of towns and rural areas. Mount Airy is the largest community and generates a significant portion of the county's court cases. Background Check Through the NC SBI
The North Carolina State Bureau of Investigation runs the central criminal records file. Based in Raleigh, the SBI has maintained this database since 1937. The Computerized Criminal History File receives data from every reporting agency in the state.
A name-based check costs $14 and searches by name and date of birth. A fingerprint check costs $38 and uses SAFIS for the most accurate results. Fingerprint matching eliminates issues with common names or aliases. The NC SBI background check page provides forms and instructions.
The SBI website covers both name-based and fingerprint-based criminal history searches.
Additional free databases are available online. The NC Sex Offender Registry lets you search by name, address, or zip code. The NC offender search from DPS shows current and past state inmates.
How Surry County Court Cases Work
Cases in Surry County are split between District and Superior Court. Misdemeanors stay in District Court. Felonies go to Superior Court. Appeals from District Court also move to Superior Court.
Case numbers use prefixes. Criminal cases begin with "CR." Civil cases begin with "CV." Traffic cases have their own codes. Learning these prefixes speeds up your search whether you are at the courthouse or using an online tool.
- Superior Court handles all felony cases
- District Court handles misdemeanors and small claims
- DWI charges may appear in both criminal and traffic records
- Juvenile cases are sealed and not publicly accessible
The NC Courts background check guide explains how to search and interpret case records from any North Carolina county.
Clearing Records Through Expunction
Expunction permanently removes a record from the court system and the SBI database. The filing fee is $175. A judge must approve the petition.
Dismissed cases often qualify. Some first-time offenses are eligible after the sentence is complete. Serious felonies and habitual offender cases are excluded. The NC Courts expunction page has eligibility rules and forms.
Once granted, the record will not appear in any future background check. There is no public way to confirm an expunction took place. North Carolina Legal Aid can help with the process at no cost. Call 1-866-219-5262 for guidance.
Note: Expunction eligibility has expanded in recent years. Check the current rules even if you were told your case did not qualify in the past.
Public Records Law
North Carolina General Statutes Chapter 132 governs public records. Most government documents are open to anyone without needing to explain why. Chapter 114 gives the SBI authority over the criminal history repository. The NC General Assembly website has the full text of both chapters.
These statutes apply to all agencies in Surry County. If a records request is denied, you have the right to challenge the denial. Agencies must respond within a reasonable time frame.
Because Surry County sits on the Virginia border, individuals who live in or near Mount Airy may have connections to Carroll County or the city of Galax in Virginia. Any criminal history in Virginia will not appear in North Carolina searches. For a complete background check on someone who has split time between both states, you would need to run separate searches through the Virginia State Police in addition to the North Carolina SBI. The Surry County clerk's office can only provide records from cases filed within North Carolina.
