The page lists office hours, contact numbers, and the courthouse address. Staff can guide you through the request process.

Union County's rapid growth over the past two decades has led to a steady increase in the number of cases processed by the clerk's office. Towns like Waxhaw, Indian Trail, Stallings, and Weddington have experienced significant population gains. Each of these towns may have their own police departments that handle local arrests. All of those cases still funnel into the Union County court system at the Monroe courthouse. When performing a background check, you do not need to visit multiple courthouses within the county. The Clerk of Superior Court in Monroe is the single point of access for all Union County criminal records.

Note: Self-service terminal searches are not certified and only cover cases filed in Union County.

Statewide Background Check Resources

The NC State Bureau of Investigation maintains the central criminal records repository for all of North Carolina. Founded in 1937, the SBI operates out of Raleigh and collects criminal history data from every law enforcement agency in the state. Their system is called the Computerized Criminal History file, or CCH.

Two types of searches are available through the SBI. A name-based search is faster but may return results for people with similar names. A fingerprint-based search uses SAFIS, the Statewide Automated Fingerprint Identification System, and ties results to a specific individual. Fingerprint checks are more reliable.

The NC Courts background check page also describes these options in detail.

Union County Background Check Process

Running a background check in Union County involves choosing the right method for your needs. Here are the primary approaches:

  1. Go to the Union County Courthouse in Monroe and use a self-service terminal for a free lookup
  2. Submit Form AOC-CR-314 with $25 for a certified single-county search
  3. Contact the SBI for a statewide name-based or fingerprint-based search
  4. Check the NC Sex Offender Registry online
  5. Search the NC DPS offender database for prison records

A county search covers Union County only. The SBI search covers all 100 counties. For the most thorough results, both can be used together. Chapter 114 of the NC General Statutes sets the rules for criminal history information sharing.

The NC Sex Offender Registry is a free tool maintained by the SBI. Search by name, zip code, or county to find registered offenders in Union County or statewide. Results include photos, addresses, and offense details.

The NC DPS Offender Search lets you look up current and former inmates in the state prison system. Enter a name or offender ID to see results. Both tools are free and open to anyone with internet access.

Note: These tools are helpful but do not replace a formal background check from the clerk or the SBI.

Expunctions and Sealed Records

Not every criminal record remains visible forever. North Carolina allows certain records to be expunged. This removes them from public view entirely. The NC Courts expunction page explains who qualifies and what steps to follow.

The filing fee is $175. Dismissed charges may qualify for a waiver. Legal Aid of North Carolina provides free help to eligible individuals. Their number is 1-866-219-5262. Once an expunction is granted, the record will not appear in background check results.

The NC General Assembly website has the full text of the statutes governing expunctions and public records access under Chapter 132.

Understanding Union County Court Records

Court records in Union County contain detailed information about each case. This includes the charges filed, the court dates, the outcome, and any sentencing. Both misdemeanor and felony cases are on file with the clerk.

Records are organized by case number. You can search by defendant name at the self-service terminals. The clerk's office can also help with specific requests if you have a case number or other identifying details.

Union County handles a high volume of cases due to its large population. Processing times for certified searches may vary depending on workload. Plan ahead if you need results by a specific date.

Union County's border with Mecklenburg County is significant for background check purposes. Many Union County residents commute to Charlotte daily and may have records filed in Mecklenburg County. Similarly, the South Carolina border runs along the southern edge of Union County. People in the Waxhaw or Mineral Springs area may have ties to Lancaster County, South Carolina. A background check limited to Union County will not show records from either of those neighboring jurisdictions. The SBI statewide search covers all North Carolina counties but does not include South Carolina records.
